Are PROs legally required to have a not-for-profit objective?
Yes. Under Article L.541-10 of the French Environmental Code, approved eco-organisations perform a public-interest mission and their statutes must state that they do not pursue a profit-making objective for their approved EPR activities.
Authorised Representative
Required for producers established outside France.
AR applicable date
12 August 2026 for the PPWR authorised-representative requirement applicable to the relevant cross-border direct-to-end-user cases involving a producer established in another EU Member State.
Packaging Covered
Household stream (EMPAP): packaging used or likely to be used by households, including relevant out-of-home packaging, plus the merged graphic-paper stream. Professional stream (EPRO): packaging serving products consumed or used by professionals. Restaurant/professional food packaging has had a dedicated REP stream since March 2024; the extension to all professional packaging is operational from 1 January 2027 after the 2026 postponement.

Effective Date
Current household-packaging modulation is governed by the 2024-2029 EMPAP approval specifications. Professional-packaging modulation is provided in the EPRO specifications, with the scheme’s operational obligations starting 1 January 2027.
Criteria
Criteria include design for recycling / recyclability in practice and at scale (especially for plastic), materials or elements that disrupt sorting or recycling, infusible materials, substances that can compromise use of recycled material, and incorporation of recycled plastic. At PRO level, detailed declarations also reflect material/component characteristics and the applicable bonus/malus schedule.
